Lew Rose specializes in consumer protection, advertising, consumer product safety law, and representing clients before federal and state law enforcement agencies and self-regulatory bodies such as the National Advertising Division of the Council of Better Business Bureaus. Mr. Rose's practice also includes counseling clients regarding advertising, marketing, electronic commerce, intellectual property issues with respect to interactive and online services and related technology.
Jodie Bernstein is widely respected among consumer groups, industry organizations and the private bar as one the country’s leading lawyers, and she counsels clients across the spectrum of privacy and consumer protection law. Her public service includes appointments as Director of the Bureau of Consumer Protection at the FTC, General Counsel of the Environmental Protection Agency and General Counsel of the Department of Health and Human Services. While at the FTC, she expanded the Bureau’s prosecution of unfair and deceptive marketing practices and fashioned federal policy on the emerging issues of identity theft, Internet privacy, and deceptive marketing practices.
David Ervin regularly counsels and advises clients on protecting their intellectual property (IP) rights, with a focus on advertising, sponsorship, licensing, e-commerce, endorsement, and joint promotion and development issues. He represents the advertisers and the advertising and promotional agencies in a specialized area that requires a comprehensive knowledge of the interplay between IP and advertising legal and business issues.
Christie Grymes serves as Chair of the firm's Consumer Product Safety Practice. She focuses on consumer protection matters, including promotions, advertising, product safety, promotions, privacy and sweepstakes. She counsels clients on all aspects of regulatory compliance, with a focus on statutes and regulations enforced by the FTC, CPSC, and state attorneys general.
August Horvath focuses his practice on advertising law and antitrust matters. He represents clients in private false advertising and deceptive practices litigation before the FTC’s Consumer Protection Bureau and the NAD and in courts around the country. His graduate training and hands-on experience in survey research and statistical analysis have enhanced his skills in developing substantiation protocols, designing and assessing research into the implied meaning of advertising claims and working with and against expert witnesses. Mr. Horvath is Co-Editor-in-Chief of the ABA’s Consumer Protection Law Developments treatise.
Alysa Zeltzer Hutnik specializes in advertising, privacy, and data security litigation and counseling. She provides counseling and representation in all forms of consumer protection matters, and regularly assists clients with privacy and data security compliance audits, forensic investigations related to information practices, data security breach notification procedures and represents companies before state and federal regulators on a range of consumer protection compliance matters.
Bill MacLeod has more than 25 years of experience representing clients in advertising challenges before the FTC, NAD, and courts under the Lanham Act. Mr. MacLeod concentrates on advertising and marketing, focusing on privacy and children and advertising. Prior to joining Kelley Drye, he served as Director of the Bureau of Consumer Protection at the Federal Trade Commission.
Gonzalo Mon assists clients in structuring a variety of advertisements and promotions including sweepstakes, contests, and loyalty programs that comply with applicable laws and offer maximum protection. In addition to domestic promotions, he has assisted his clients with clearing promotions in more than 25 countries. Mr. Mon reviews advertisements in print and media to determine compliance with relevant regulations, as well as risk of challenge from regulators and competitors.
Sarah Roller, J.D., R.D., M.P.H., serves as Chair of the firm’s Food and Drug Law Practice. She specializes in the representation of U.S. and global companies and industry trade organizations engaged in the development, manufacture, import, export, distribution, and marketing of foods, beverages, dietary supplements, functional foods, nutraceuticals, medical foods, cosmetics, medicines, and other personal health care and wellness products domestically and abroad. Providing integrated counseling services spanning the legal, regulatory and legislative arenas, Ms. Roller also has extensive experience representing her clients in complex legal, policy, and enforcement matters before federal and state agencies.
Dana Rosenfeld is Chair of the firm’s Privacy and Information Security Practice. She focuses on all facets of privacy and data security, advertising and consumer financial issues at the federal and state level. Ms. Rosenfeld’s public service included assignments as advisor to FTC Chairman Robert Pitofsky, as senior legal advisor to the Director of the Bureau of Consumer Protection, and as Assistant Director of the FTC’s Bureau of Consumer Protection. While Assistant Director, Ms. Rosenfeld was responsible for coordinating consumer protection policy on advertising and electronic commerce issues.
John Villafranco provides litigation and counseling services to corporations involved in advertising and marketing. His experience includes Lanham Act litigation, consumer class action defense, representation of clients in advertising substantiation proceedings and investigations conducted by the FTC and state attorneys general, and representation of challengers and advertisers before the NAD and the NARB.
John Heitmann advises broadband and Internet service providers on a broad range of privacy, data security, and communications law issues. He has more than fifteen years of experience representing clients on regulatory policy, litigation, dispute resolution and enforcement matters before regulatory agencies, and in state, federal and appellate court litigation. He counsels extensively on compliance policies and issues arising from the Communications Act, the FTC Act, and numerous other laws governing privacy, information security and telecommunications law issues.
Daniel Blynn concentrates primarily on civil litigation and complex class actions. Mr. Blynn has represented clients in both state and federal courts, as well as advocated on their behalf at the federal appellate level. In addition, Mr. Blynn represents clients in advertising substantiation investigations and inquiries from the Federal Trade Commission.
Katie Bond helps clients comply with the FDA and FTC regulations for marketing and selling products. She specializes in food and drug law, and has significant experience reviewing dietary supplement labels, fact panels, and marketing material to ensure compliance with FDA laws and regulations. Ms. Bond also counsels clients on claims substantiation required by the FDA and FTC and, when necessary, provides assistance with product recall strategies and implementation under FDA rules.
Kristin Hird focuses on consumer protection matters, including advertising and privacy and information security. She counsels clients regarding state and federal consumer protection laws and regulations as well as all aspects of regulatory compliance with the FTC. She also represents clients involved in FTC, state and private investigations and litigation involving advertising claims. Ms. Hird has a particular focus on privacy and data security, deceptive practices, and electronic commerce matters that affect financial institutions, including banks, credit unions and credit card issuers.
Chris Loeffler concentrates his practice on consumer protection issues, promotions, licensing, data security and privacy. Prior to joining Kelley Drye, Mr. Loeffler was a Summer Associate at the firm. He also worked as an intern for TBWA Worldwide, an advertising agency in New York City, and as an intern at the Federal Trade Commission, Bureau of Consumer Protection's International Division in Washington, DC.
Elisa Nemiroff counsels clients on all aspects of regulatory compliance pertaining to advertising, food and drug, and privacy law. She counsels clients on issues regarding regulations, statutes, and policies enforced by the FTC mission and states attorneys general, including laws regarding unfair an deceptive practices, weight loss and dietary supplement advertising, telemarketing, negative option and free trial programs, unsolicited commercial e-mail, endorsements and testimonials, and pricing.
Megan Olsen focuses her practice on helping clients comply with Federal Trade Commission advertising and marketing regulations and privacy and information security practices.
Ms. Pippins focuses her practice on consumer law counseling, including advertising, food and drug law, privacy and data security, and intellectual property issues. She has particular experience representing food and pharmaceutical companies in FTC investigations and advising the food industry in complying with federal guidelines as they relate to food marketing.
Katie Rogers counsels clients on compliance with the Food and Drug Administration (FDA), the Federal Trade Commission (FTC), and related federal and state agency laws and regulations for marketing and selling products. Previously, Ms. Rogers was an Associate at another Washington, DC-based international law firm where she gained a broad range of experience with food and drug law issues. Ms. Rogers regularly assisted companies in obtaining FDA pre-market approval for their food packaging, food, and drug products.
Matt Sullivan focuses his practice in the areas of advertising, privacy and information security, and consumer protection. Mr. Sullivan counsels clients regarding all aspects of regulatory compliance with FTC, and state statute and trade regulation rules. Mr. Sullivan assists clients involved in FTC and state investigations involving advertising and consumer protection claims. Prior to joining Kelley Drye, Mr. Sullivan worked for a national wireless service provider where he provided public affairs and crisis communications support and developed social media policies and programs.
Kristi Wolff concentrates on advertising, promotions, and food and drug law matters. Her advertising and marketing law expertise includes counseling clients on the marketing and sale of retail food, medical food, weight loss and medical device products to consumers and health care professionals through a variety of channels. She has experience advising across the full product lifecycle, including manufacturing, new product launches, clinical trials and product recalls. Prior to joining Kelley Drye, Ms. Wolff was associate general counsel at Nestlé HealthCare Nutrition, Inc., a subsidiary of Nestlé S.A., and also served as senior counsel at Assurant Health.
